tGFX - Terms and Conditions

Welcome to the tGFX website! These Terms of Service ("TOS") govern your use of my graphic design services. If you'd read them, that'd be great, as they're not super long. By placing an order/request, you agree to the following terms.

1. Services

I create graphics and designs based on your instructions. Final deliverables will be provided in the agreed format.

2. Payment

Full payment through Cash App or Venmo is due before the final product is sent. Payments are also non-refundable.

3. Revision Policy

Clients receive infinite revisions/piece at no additional cost within their INITIAL REQUEST. If a final design is sent and the client asks for more revisions, they come at additional costs.

4. Usage Rights

Upon full payment, clients are granted a non-exclusive, non-transferable liscense to use the graphics/designs for their intented purposes (e.g., YouTube, social media). I retain the right to display the work in my portfolio.

5. Refund Policy

Due to the custom digital nature of the products, refunds are not avaliable after final product is sent. If there are issues, please contact me via Discord @tuckgurt.

6. Intellectual Property

Clients agree not to claim ownership of any liscensed or stock assets included in designs. Unauthorized resale or redistribution is prohibited.

7. Turnaround/Delivery Time

Typical turnaround time is maximum 5 days.

8. Cancellation

If a client decides to cancel after work has already begun, there is a cancellation fee of $1.00.

9. Limitation of Liability

My liability is limited to the amount paid by the client. I am not responsible for any indirect damages or losses.

10. Dispute Resolution

If there are any issues or conflicts, you agree to work it out with me through friendly communication.

11. Prohibited Activities

Clients may not use my services to promote illegal activities, infringe copyrights, or redistribute my work without permission. Any design requests also MUST follow the guidlines of the platform it will be used on. The following community guidelines are linked: YouTube, X, Instagram, Twitch, Discord.

12. Communication

Clear and timely communication is essential. Please provide detailed instructions and respond promptly.

13. Governing Law

These Terms and Conditions are governed by the laws of the state of New York. Any legal matters related to these terms will be handled according to the laws of this state.
